We anticipate initiating litigation on behalf of Covid EIDL applicants who amended, or attempted to amend, their applications or supporting documents and were penalized for doing so.

WHO IS ELIGIBLE TO JOIN AS A NAMED PLAINTIFF?
You are eligible to join as a named plaintiff if the following two conditions apply:
1. You amended, or attempted to amend, your loan application;
You submitted, or attempted to submit, amended documents in support of your loan application/request for an increase;
2. You did not receive the anticipated benefit of the amended information.
WHAT IS THE PURPOSE OF THIS LITIGATION?
This litigation will challenge the SBA's rules, practices, and procedures that denied otherwise eligible applicants meaningful participation in the EIDL program as implemented by Congress. The litigation will seek declaratory relief, equitable remedies, and statutory damages on behalf of the named plaintiffs.
HOW DO I JOIN AS A NAMED PLAINTIFF?
Submit the Eligibility Questionnaire. We will let you know by email if you are eligible and, if so, send further instructions on completing the required steps: 1) uploading documents; 2) signing a contract of representation; and 3) paying the legal fees.
I MADE A MISTAKE ON MY APPLICATION; WHEN I TRIED TO CORRECT THE MISTAKE I WAS FLAGGED FOR FRAUD. AM I ELIGIBLE?
Yes. We will be challenging the SBA's flawed amendment process which unfairly disqualified eligible applicants in a variety of ways for a variety of reasons.
WHAT ARE THE LEGAL FEES?
There will be a fee of $800 to join the lawsuit as a named plaintiff.
A second payment will be due if and only if you receive a favorable outcome: if the SBA reopens adjudication of your loan application/increase submission an additional $500 will be due. If you receive damages from the court or from a settlement the Firm will collect 20%.
The Firm will refund the initial fee in full if the lawsuit is not filed. Otherwise, the initial fee is considered earned on payment and is not refundable.
You will not be responsible for any fees, charges, costs, or expenses related to this litigation other than the fees identified above.
CAN I PARTICIPATE IN MORE THAN ONE LOLRG EIDL LAWSUIT?
No. While you may be eligible to join more than one lawsuit you can be a named plaintiff in only one. Upon review of your questionnaire and supporting documents we will recommend the best lawsuit for you.
HOW WILL NAMED PLAINTIFFS BE KEPT APPRISED OF DEVELOPMENTS IN THE CASE?
Named plaintiffs will have their own members-only portal on this website where we will provide regular updates, share legal documents, and hold scheduled chats. We will also hold zoom calls where named plaintiffs will receive updates and be able to ask questions of the lead counsel.
Please note: due to the nature of aggregate litigation the Firm will not be responding to individual inquiries regarding this litigation or the underlying loans outside of the members-only portal and scheduled group settings.
